By downloading, installing or using FOV Pro, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.
FOV Pro is operated by Makalen Pty Ltd (ABN 51 698 787 567), incorporated in New South Wales, Australia (“we”, “us”, “our”).
FOV Pro is a mobile application that simulates the field of view of CCTV cameras using your smartphone camera. It is designed as a planning and pre-installation verification tool for security professionals, consultants, and end users.
FOV Pro provides simulation results based on published manufacturer specifications. Results are approximations and are not engineering measurements, certification outputs, or guarantees of real-world camera performance.
FOV Pro is intended to assist users in planning CCTV deployments. The application is not a substitute for professional skill, judgement or site inspection. Users remain solely responsible for selecting suitable equipment, verifying camera placement, confirming compliance with client requirements and applicable standards, and ensuring installed systems meet operational requirements.
During the launch period, a 14-day free trial may be offered for Pro plans where payment details are provided upfront. The trial period and availability is subject to change without notice.
All prices are in Australian Dollars (AUD) unless otherwise stated. International users may see localised pricing displayed by the relevant app store or payment platform.
We reserve the right to change subscription pricing. Existing subscribers will receive at least 30 days notice of any price increase before it takes effect on their renewal.
Pro Monthly and Pro Annual subscriptions automatically renew at the end of each billing period unless cancelled. You authorise us (or the relevant app store) to charge your payment method on the renewal date.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until then. To cancel:

Refunds for purchases made through the Google Play Store are subject to Google Play’s refund policy.

For purchases made directly through our website, refund requests should be directed to support@fovpro.com.au within 14 days of purchase. We will consider refund requests on a case-by-case basis.
If you create an account or register with FOV Pro, you are responsible for:

You retain ownership of all project data, captures, and other content you create or upload within FOV Pro.
By using the service, you grant Makalen Pty Ltd a limited, non-exclusive licence to store, process, and display your data solely for the purpose of operating and providing the FOV Pro service to you. This licence terminates when you delete your data or close your account.

Actual camera coverage may vary due to lens tolerances, mounting angle, environmental conditions, firmware versions, and other factors outside our control. You are responsible for verifying camera coverage on installation.
FOV Pro is provided “as is” and “as available”. We do not warrant that FOV Pro will be uninterrupted, error-free, complete, or suitable for every installation. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by Australian law, our total liability to you for any claim arising from your use of FOV Pro is limited to the greater of: (a) the total fees you paid for FOV Pro during the 12 months preceding the claim; or (b) AUD $100.
We are not liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, loss of data, installation costs, variation claims, return visit costs, incorrect camera selection, missed coverage, security incidents, theft, property damage, personal injury, regulatory non-compliance, contractual disputes, or consequential commercial losses arising from your use of or reliance on FOV Pro simulation results.
We are not liable for any delay, failure, or interruption of the service caused by events beyond our reasonable control, including but not limited to natural disasters, power outages, internet or telecommunications failures, third-party hosting or infrastructure outages, government actions, or pandemics.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law that cannot be excluded.
FOV Pro, including the application code, database, camera specifications, FOV calculation methodology, brand name, logo, and all associated materials, is owned by Makalen Pty Ltd and protected by Australian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use FOV Pro for your personal or business purposes in accordance with these terms. You may not:

We may suspend your access to FOV Pro, without prior notice, if we reasonably believe you are engaging in any of the following:
We reserve the right to terminate your access to FOV Pro at any time if you breach these terms. On termination, your licence to use the app ceases immediately. Provisions of these terms that by their nature should survive termination will do so, including but not limited to limitation of liability, intellectual property, and governing law.
FOV Pro may incorporate features that use artificial intelligence or machine learning to generate recommendations, suggestions, or analysis. Any AI-generated recommendations are provided for informational purposes only and should be independently verified by a qualified professional before implementation. We make no warranty as to the accuracy, completeness, or suitability of any AI-generated output.
You must not use, export, or re-export FOV Pro in violation of any applicable export control laws, trade sanctions, or regulations, including those of Australia, the United States, and any other relevant jurisdiction.
We may update these Terms of Service from time to time. We will notify you of material changes by updating the “Last updated” date. Continued use of FOV Pro after changes are posted constitutes acceptance of the updated terms.
These Terms of Service are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales for the resolution of any disputes arising from these terms or your use of FOV Pro.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Makalen Pty Ltd in relation to your use of FOV Pro and supersede all prior agreements, representations, and understandings.
If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these terms does not constitute a waiver of that right or provision. Any waiver of any provision of these terms will be effective only if in writing and signed by Makalen Pty Ltd.
